摘 要:行政协议争端解决机制是行政协议真正发挥其优势作用的最后一道屏障,大量行政协议出现急需争端解决机制,而实践中该机制尚未建立。然而,行政协议争端解决机制建构有法理依据做支撑,同时可以从现实理据中借鉴成功经验,不仅如此,我国法制土壤中有其生存空间。因而可以选择符合我国国情的模式和具体救济措施构建我国行政协议争端解决机制。The dispute settlement mechanisms are the last barrier for administrative agreemerIts to truly make use of their advantages, and these mechanisms have not been established in practice while the dis- pute settlement mechanisms are in great need due to a large number of emerging administrative agree- ments. However, there is jurisprudential evidence that is the basis of establishing dispute settlement mechanisms,and the successful experience in reality can be made use of as well.Furthermore, there is a space for its existence in the soil of our legal system. Therefore, dispute settlement mechanisms for ad- ministrative agreements could be established by using the mode and specific remedies corresponding to the situations in our country.
