摘 要:基于当事人授权理论、法律授权理论、完成使命理论等理论支撑,仲裁庭有权决定自身管辖权。确立并完善我国仲裁庭自裁管辖权原则,需通过延后法院介入仲裁的时机、增加法院对不服仲裁庭裁定的受诉规定、废除法院内部的层报制度,进而规范法院对于仲裁的司法控制;同时,需取消仲裁机构的管辖权异议决定权、撤消仲裁机构的前置表面审查程序,使得仲裁机构回归其辅助地位的本位;还需弥补现行仲裁庭不开庭审理情形的立法疏漏、扩充仲裁庭审理管辖权异议案由、赋予仲裁庭对继续仲裁程序的自由裁量权,从而健全仲裁庭审查权限。Based on the support of three theories: the theory of parties authorized, the theory of legal authority and the theory of completion mission, the arbitration tribunal shall have the right to determine its own jurisdiction. To establish and perfect the Competence/Competence principle of China's arbitration tribunal, it needs to postpone the time for the court to intervene in the arbitration, increase the provisions of the court against the ruling of the arbitration tribunal and abolish the internal approval system in the court, and then regulate the judicial control of the court to arbitration. Moreover, it needs to cancel the right of dissent to jurisdiction of arbitration institutions, cancel the pre-surface examination procedure of the arbitration institution, making the arbitration institution return to its auxiliary position. And also, it needs to make up the legislative oversight that the arbitration tribunal closes hearing the case, expand the objection to the jurisdiction of an arbitration tribunal to hear the case, give arbitration tribunal the discretionary power of continuing arbitration procedure, so as to improve the review authority of arbitration tribunal.
