摘　　要：随着行政伦理学的产生,行政道德立法现已成为西方国家反腐败的共同选择。这一趋势从20世纪开始,至今仍保持着强劲的发展态势,而且成为世界廉政建设的一大浪潮。在社会转型期,人们对公务员道德立法缺乏正确认识,而美国以法律的形式规范公务员道德、预防腐败犯罪的理论和实践,对于目前我国的行政法治建设以及拟出台的《国家反腐败法》的立法都具有借鉴意义。本文以20世纪美国公务员道德立法英文原文为第一手资料,从法理学视角在实证研究的基础上对美国公务员道德立法进行评析,目的是为我国行政道德立法提供经验和参考。With the emergence of administrative ethics, administrative ethics legislation has become the common choice of anticorruption in Western countries. From the beginning of twentieth Century, this trend has maintained a strong momentum of development and become a major wave of world clean government. In the period of social transformation, people is in lack of correct understanding of the civil moral legislation, and the theory and practice of moral norms of civil servants of the United States may have reference significance for the current construction of China's administrative law, especially for the legislation of National Law of Anti-corruption. From the perspective of jurisprudence on the basis of empirical research on the civil servants moral legislation assessment, using data of US civil service ethics legislation as original first-hand facts, this study aims at analyzing US civil service ethics legislation, which may provide some experiences and references for China's administrative ethics legislation.
