新形势下国际私法教学思考——以“高铁走出去”的法律服务为视角

摘　　要：中国铁路企业在国际化进程中取得了令人瞩目的成就,同时在很多投资项目上也付出了惨重的代价,集中反映出我国高校国际法人才培养方面的弊端。企业在国际法层面面临的主要法律——国际私法的教学应该从几个方面开展:重视理论学习与实践环节相对应的教学;加强主要经典学说的方法论教学;基本法律制度及法律适用规则采用逆向教学;进行相关学科之间、涉外案例和国内案例之间及法律适用的比较教学。In the process of internationalization, China railway enterprise has achieved remarkable achievements and meanwhile also paid a heavy price for many investment projects, intensively reflecting the drawbacks of cultivating the international law professionals in China＇s universities. The laws that enterprises face at the international level -in- ternational private law should be taught in such aspects as： emphasis on the teaching the theoretical study correspond- ing with the practice; strengthening the teaching of methodology of major classical theory; using the reverse teaching in terms of basic legal system and rules applicable to law; carrying out the comparative teaching between related disciplines, foreign and domestic cases, and applicable laws.
