摘　　要：虽然我国环境民事公益诉讼制度日趋完善,但由于生态环境损害难以量化以及司法实践较为贫乏,使得具体赔偿数额的确定仍未得到有效的解决。为保障环境民事公益诉讼赔偿功能的实现,要直面环境民事公益诉讼赔偿数额确定之困境并加以因应,紧密结合环境民事公益诉讼法律法规及其相关司法解释的规定,提炼出环境民事公益诉讼赔偿功能和范围,理清各种不同赔偿范围下须考量的问题,从相关法律法规及评估规则的完善以及司法实践中确立良好的裁判准则出发,探寻环境民事公益诉讼赔偿数额的量化之法,进而明确我国环境民事公益诉讼损害数额确定的基本路径,使受损的环境公共利益获得更为有效的司法救济。Although the civil environmental public interest litigation system is in- creasingly perfect, but due to the ecological environmental damage is difficult to quantify and ju- dicial practice is relatively poor, so the determination of compensation has not been solved effec- tively. To ensure the realization of the function of civil environmental public interest litigation compensation, to face the plight of determination of the compensation amount in the civil environ- mental public interest litigation and to take proper responses to the plight. Closely contacting the provisions of the relevant laws and regulations and judicial interpretations, extracting the function and scope of the civil environmental public interest litigation compensation, clarify the facters, which must be taken account of, in all the different scope of compensation, and based upon the perfection of laws and regulations and evaluation rules, and judicial practice to establish good guidelines, to search for quantitative method of amount of compensation in the civil environmental public interest litigation, and then clear the basic path to determination of amount of compensation in the civil environmental public interest litigation, and finally the damaged environment public interest would obtain more effective judicial remedies.
