摘　　要：民事诉讼证据调查令制度对解决了当事人及其代理人因为客观原因无法通过自身获取相应证据具有重要作用。然而,由于调查令制度实践时间不长,仍然存在调查令制度运行缺乏立法的支撑、调查令的权利属性不明确、没有区分调查令的申请主体与持令主体、调查令适用的主体范围不明确、调查令适用的证据种类没有明确、责罚体系缺失等问题。对此,可以从在民事诉讼法及相关法律中明确规定调查令制度、对调查令的适用情形和适用阶段的具体规定、明确调查令的申领主体和被调查主体、调查令调查证据的类型、调查令审查签发程序和不予签发调查令的情形、调查令使用的具体程序要求、违反调查令制度的法律后果等方面进行完善,实现其价值目标。Evidence in Civil Proceedings investigation system to address the parties and their agents because of objective reasons can not obtain the corresponding evidence by itself has an important role. However, since the investigation system practice time is not long, there is still investigation system running a lack of supporting legislation, the right to property investigation order is not clear, did not apply for the main distinction between investigation order and hold to make the body, investigation order applies subject range is not clear investigation of the types of evidence do not apply so clear, lack of punishment system and other issues. In this regard, from the Civil Procedure Law and related legislation clearly stipulates investigation system, the specific circumstances and applicable provisions of the applicable stage of the investigation order, apply a clear survey and investigation of the body so that the body, the type of investigation Investigators evidence specific procedural investigation order issued by the review procedures and shall not issue orders investigation of the case, to make use of survey requirements, in violation of legal consequences investigation system will be perfect, to achieve its objective value.
