摘　　要：司法的最高境界是善治艺术。中国古代以士大夫为主体的司法官员们,能够高度自觉地将其道德良知、人文关怀、博爱精神、美学原则以及正义情感,以艺术性的方式、方法与风格,创造性地表达并融贯于其自身的司法实践过程之中,最终有效地化解了社会纷争。中国古代司法善治艺术形态主要体现在司法官员们的"父母官诉讼"式的亲民艺术情怀,以及正名分、重人伦、美教化、厚风俗的德礼教谕艺术。古代司法善治艺术是中国传统司法经验、理性和智慧的结晶,无疑能为当代中国司法文明建设提供可资借鉴的历史本土法律文化资源。The highest realm of justice is a kind of art of good governance. The ancient Chinese judicial officials, who were mainly made up of scholar - officials, were able to make their moral conscience, humanism, philanthropy, aesthetic principles and feelings of justice, in an artistic manner, method and style, creatively applied and me/ted into their judicial practice with the high consciousness, which finally effective- ly resolved social disputes. Ancient Chinese art form of good governance mainly showed in two aspects. First of all, the ancient Chinese judicial officials were full of artistic feelings and close to their people in the Lawsuit handled in family way. Secondly, the ancient Chinese judicial offi- cials, who paid atention to a person~ status, ethics, enlightenment, customs, were good at teachings arts of morality and etiquette. The ancient art of good gnvernance is a traditional juditecial experience, reason and wisdom crystalized, which undoubtedly can provide some valuably law and cultural resources of the native Chinese history for the contemporary civilization of justice.
