摘　　要：明确土地发展权的性质使得优化配置土地资源功能得到充分发挥,并且可以更好地保护土地发展权主体的权益。在此背景下首先通过土地使用权性质的改变和土地利用程度两个方面去界定土地发展权的概念,接着对目前关于土地发展权法律性质的学说:私权说、公权说、公私双重属性说进行理论分析,层层递进,完整地揭示了土地发展权的法律性质,即土地发展权是一种新型的用益物权,是对传统物权体系的充实和发展,有利于解决外部性问题和实现可持续发展之目的。The nature of the land development right makes the optimization of the allocation of land resources function to be fully played, and can better protect the interests of the main body of the land development rights. Under this background, this paper first defines the concept of land development rights through two aspects： the change of land use right and the degree of land use, Then the current on the legal nature of the land development public and private nature of the righ usufructuary right rights theory： private right of public power and said, double the properties analysis said, progressive layers, fully reveals the legal t of land development, land development right is a new type of , is to enrich and develop the traditional property system, is conducive to to solve the problem of externality and achieve the objective of sustainable development.
