网络交易平台专利侵权中“通知-删除”规则适用问题研究——兼论《专利法修订草案(送审稿)》第63条第2款的完善

摘　　要：针对网络交易平台中专利侵权问题,《专利法》第四次修订草案(送审稿)中增加了第63条第2款,加大了网络服务商的责任承担。但是,该新增条款由于忽略了"通知-删除"规则保护对象的特殊性,未考虑到专利侵权判断的困难性,立法技术上过于简单,缺乏具体实施要件,导致日益猖獗的侵权现象难以遏止。因此,需要完善通知规则,创设转通知规则,保证网络用户及时进行申辩的权利,从而实现权利人、网络服务提供者和网络用户之间的利益平衡。For the patent infringement in network trading platform, Article 63（2） , was added to the fourth revised draft of the Patent Law, and the “ notice - take down” rule of the copyright law was introduced into the field of patent law. The new terms ignore the “ no-tice - take down” rule protects particular object and do not take the difficulty of patent infringement judgments into account in the in-fringement. At the same time, the legislative technology is too simple. Those all may lead to chaos of judicial practice. This paper pro-poses to set up a anotice - turn notification - delete” rule to ensure that the network user has the defending right,so that we can a-chieve the interest balance between right owners, internet service providers and network users.
