摘  要:权力清单制度的推行已经在全国广泛铺开,如何清理行政权是制定权力清单的第一步。行政权本质上是一种由法律设定、受法律控制的国家公权力,必须遵循法律保留原则。在清权时,应首先区分负担性行政权和授益性行政权,对于负担性行政权,要严格按照我国现有法律规范,从行政权设定依据的法律位阶和制定主体的立法权限等方面进行清理;对于授益性行政权,除少数事项必须严格适用法律保留原则外,其他事项可以在法律位阶、立法权限等方面适当放宽。The er is the first step of power lists system has been established nationwide. How to sort out the administrative powmaking power lists. The essence of administrative power is one type of national public power, which is created and controlled by law. It must abide by the Principle of Law Reservation. When sorting out the administrative power, it should be divided into two categories first:obligation imposing administrative power and interests granting administrative power. As to the first category, it should be strictly limited by our current laws in the aspect of legal hierarchy of its legal basis, legislative competence of its legislator, etc. With regard to the second category, except specific items must strictly abide by the principle of law reservation, most could be relatively eased in the aspect of legal hierarchy, legislative competence, etc.
