论法学教育中的伦理之维

摘　　要：伦理教育不仅是法学教育不可或缺的重要组成部分,而且是应当置于法学教育首位的问题;法律伦理教育有利于促进法律人自由人格的养成、促进法律人法治践行能力的提升、促进法律制度的伦理性完善以及社会整体法治氛围的形成;由于我国法学教育的独特发展历程以及社会转型期高等教育市场化带来的影响,我国法学教育中的伦理教育存在明显不足;法律伦理教育应当包括法律制度伦理教育和法律职业伦理教育两个方面;实现有效的法律伦理教育应从确立法律伦理学的核心课程地位、加强法律伦理学学科建设、改革课堂教学方法、强化法律实践教学以及净化校园文化等方面予以着手。Ethic education is of prior importance in legal education, which is beneficial for cultivation of free personality, for enhancement of legal practical ability, for perfection of the legal systems and for establishment of the atmosphere of rule of law; Legal ethic education in China is seriously insufficient due to the impact of the particular process of legal education development as well as the marketization of higher education during our social transformation; Legal ethic education includes two aspects： legal system ethic education and legal profession ethic education; Effective measures should be taken to drive up the legal ethic education,including making the course of legal ethic education as core curriculum,strengthening discipline construction of legal ethic,reforming the class teaching methods,emphasizing the legal practical teaching,purifying the campus culture,etc.
