摘　　要：文章剖析了医疗纠纷欠费的法律性质,认为医患双方存在医疗服务合同关系,患者方享用医疗服务后不支付医疗费用属违约行为;由此,重点分析了相关诉讼案由、管辖法院的选择及法律适用,并从医疗机构内部管理、确定适格被告、签署还款协议和全面收集证据等方面提出了应对策略。This paper analyzes the legal nature of medical dispute arrearages and points out that both doctors and patients have the relationship of medical service contract, the patients＇ behavior of not performing the obligation of payment is a breach of contract. Based on, this paper selectively analyzes the cause of action, the choice of jurisdiction of the court and the application of law, and puts forward some countermeasures from the aspects of medical institutions internal management, the determination of eligible defendant, the signature of repayment agreement, and comprehensive collection of evidence, etc..
