摘 要:目的通过分析山西省33例调解成功案例的特点,总结医疗纠纷人民调解委员会成功调解案例的经验和不足,为地方立法提供借鉴,为人民调解实施和完善提出理论指导。方法以2013年~2014年山西省33例成功调解的案例为研究对象,对案例特点进行量化分析。结果医疗纠纷发生最多的科室是妇产科;医疗纠纷发生的原因与医生的行为有很大关系;医疗纠纷的成功调解主要的配合单位是医院,必要途径是专家评估与事故鉴定。结论成功调解医疗纠纷需要医院重视重点科室的建设和发展,积极配合医疗纠纷调解人员;医务人员明确职责;政府需加强医疗技术专家评估和医疗责任保险事故鉴定的队伍建设;各个部门携手解决尖锐的医患矛盾,共创和谐的医患氛围。Objective By analyzing the characteristics of 33 successfully resolved cases in Shanxi Province and summarizing the experience and defects of cases successfully resolved by the People's Mediation Committee of Medical Disputes, the paper aims to provide reference for local legislation and theoretical guidance for the implementation and improvement of people's mediation. Method 33 successfully resolved cases in Shanxi Province from 2013 to 2014 were taken as the object of study to carry out quantitative analysis on their characteristics. Result The department of gynaecology and obstetrics was where medical disputes happened most frequently; the causes of medical disputes were closely connected with the behaviors of doctors; hospital was the main cooperation unit for the successful resolution of medical disputes, and the necessary approaches were expert evaluation and malpractice assessment. Conclusion To successfully resolve medical disputes, hospitals need to attach importance to the establishment and development of key departments, actively cooperate with mediation personnel, and define the duties of medical personnel; the government need to focus on the enhancement of team building for medical technical expert evaluation and the identification of medical liabilities and insurance accidents; various departments should work together to resolve sharp doctor-patient contradiction and create a harmonious atmosphere between the two groups.
