摘　　要：申诉在我国特定历史时期发挥了化解社会矛盾的作用,但在当下社会转型时期对司法裁判终局效力产生了一定的冲击,造成各种"乱象"。彻底的解决对策是废除该制度,而现阶段较为可行的策略是将其作为法院附设非诉讼纠纷解决机制,与申请再审程序共存。《中共中央关于全面推进依法治国若干重大问题的决定》提出建立律师代理申诉制度,旨在引导申诉走向法治轨道。律师代理申诉本质上一种中立的第三方评估机制,其运行机制符合司法特性,遵循评估原则和回归程序原则。为破解该制度与相关程序和制度存在的兼容性障碍,应从律师代理的参与机制、程序保障和法律效力等三个层面进行具体制度构建。The appeal has resolved social problems in the specific historical period of our country, but in the period of social transformation, it has impacted the final effect of judicial adjudication accordingly, and then resulted in all kinds of chaos. A completed countermeasure is to abolish the system, but the feasible strategy at the present stage is taking the system as a non-litigation dispute resolution mechanism of the court, and coexisting with the procedure of application for retrial. The appeal system of lawyer agency was presented in the fourth plenary session of the 18th Communist Party of China Cen- tral Committee on the Decision on Some Major Issues Concerning Comprehensively Advancing the Rule of Law, which is to guide the appeal to the rule of law. Lawyer agency for appeal is essentially a neutral third party assessment mechanism, Its operating mechanism conforms to the judicial characteristics, and follows the principles of assessment and regression procedures. In order to break the barrier of compatibility between this system and relevant procedures and systems, we should establish the specific system from three aspects： the participation mechanism of lawyer agency, procedural guarantee, and legal effect.
