庭审实质化的技术路径反思与政治路径证成

摘　　要：庭审实质化改革目前呈现一幅技术主义改革图景,取得了初步成效,也有值得反思之处。技术路径无法应对庭审实质化改革存在的法院对公安、检察机关的制度性制约能力不足这一积难问题。政治路径与技术路径互为补充、相互协作,是对技术路径无法解决的法院制约能力不足等涉及司法体制的深层次问题作出的回应和相应的政治安排。政治路径通过提高法院的政治地位和政治待遇等政治举措来加强法院的司法制约能力,从而完成庭审实质化的改革任务。根据实际情况,政治路径在中央和地方层面可以有不同的方案。The substantiation of court trial presents a picture of legal solution, which achieves some initial success, but there are also some points that need to be rethought. The legal solution cannot cope with the deep-seated problem of the substantiation of court trial that the court can＇t effectively restricts procura- torate and public security organ. Legal solution and political solution complement and cooperate each other. The political solution belongs to a political response and arrangement to the deep-seated problems of the judicial system which legal solution is unable to solve. By improving the court＇s political status and political treatment, the political solution strengthens the court＇s judicial restraint ability, so that to completes the tasks of substantiation of court trial. According to the actual situation, we would choose different plans at the central and local levels.
