摘　　要：随着社会经济的发展,我国电子废弃物的数量呈现"爆炸式"的急速增长,由于电子废弃物具有双面性,回收处理得当就能在"垃圾围城"中实现经济增长与环境保护的双赢。目前,尽管将电子废弃物的回收纳入市场机制之中,但仍然深陷混乱与无序的困境。究其原因,主要是由"市场失灵"与"政府失位"两方面造成的。就中国的实际状况而言,电子废弃物回收的立法趋向应当是,以市场为主导的政府监管,实行行为主体差异化激励。应当构建电子废弃物回收的多方负责机制,采用电子废弃物回收的市场经济手段,完善电子废弃物回收的配套法律制度,并设置电子废弃物回收的物质保障措施,从而促进电子废弃物回收的规范化、有序化。This paper dealt with e-waste disposal, discussing its two-sided property： if properly recycled, e-waste will achieve win-win results balancing economic growth and environmental protection; otherwise it will aggravate the ＂garbage siege＂ situation we face presently. Nowadays, recycling of e-waste has been incorporated into market mechanism, however in a disorder way; reasons were analyzed as ＂market failure＂ and ＂government defaults＂, according to the authors. The paper pointed out that the trend of legislation regarding e-waste recycling should be the market-oriented system with governmental supervision plus differentiated incentives of the action body. Furthermore, it was suggested that a multi-party responsibility mechanism for e-waste recycling should be set up, the e-waste recycling market economic measures be taken to improve the relevant legal system for e-waste recycling, as well as to build e-waste recycling material safeguards so that the ordering and standardization of e-waste recycling could be facilitated.
