摘　　要：举证责任分配在医疗侵权诉讼中起着至关重要的作用,是医患双方关注的焦点,也是查明案件事实,正确适用法律的核心要素。本文借鉴德国的有关医疗侵权举证责任理论及司法实践,提出在医疗侵权诉讼中实行有限的举证责任倒置,在医患双方举证责任的分配上找到相对的契合点,以推动医疗侵权案件公平、公正的审理。The distribution of burden of proof plays a vital role in medical tort litigation, which is the focus of both doctors and patients and the core elements of the law. This paper draws on the relevant medical tort theory and judicial practice abroad, and puts forward a limited burden of proof in medical tort litigation, and finds a relative balance between the distribution of the burden of proof of the parties to promote the fair handling of medical tort cases.
