摘 要:保障人民群众参与司法是新时期全面法治的价值要求和新一轮司法改革的重要内容。司法听证有助于将司法与人民、法意与民意有机连接起来,从而成为推进人民群众有序参与司法的重要渠道。中国司法听证制度总体上处于探索期,为矫正实践中各种误读和滥用现象,有必要在一些共通性、基本性问题上逐步规范化。在群众参与的视角下,中国司法听证制度的规范化需着力解决司法听证官、听证主持人和人民听证员的规范化遴选,确保司法听证官、听证主持人的中立性与独立性,提升人民听证员的广泛性、代表性和履职能力;需构建规范化的听证评议运行机制,保障人民听证员有效而深入的听证参与;需逐步确立司法听证报告作为司法机关最终决定依据的实质效力地位。It is the essential requirement and important content of rule of law reform in the new era to ensure the people's participation in justice. Judicial hearing is helpful to connect the justice and the people,the law and public opinion,and then open channels for the masses to participate in justice. Our judicial heating system is in the exploration period in general which should be unified on some common and fundamental issues in order to correct various misreading and abuse phenomena. From the perspective of promoting public judicial participation ,we should set up the selection mechanism of judicial hearing officers and people hearing personnel in order to insure hearing officers' neutrality and independence,promote people hearing personnel's universality, representativeness and performance ability; build the normalized operation of judicial hearing discussion in order to ensure effective and thorough participation of people hearing personnel; establish gradually the substantive validity of hearing report towards judicial authorities as their basis of decision.
