摘 要:西方古典的灵魂宪法指的是共同体的生活方式,它关注人的灵魂,目标是培养公民的德性,目标的实现依赖于教育。西方现代的身体宪法指的是创设国家的根本法律,它关注人的身体,目标是保护公民的权利,目标的实现依赖于立法技术和制度设计。西方宪法概念的古今变化对中国主要有两点启示:其一,"人"是理解西方宪法概念的钥匙;其二,不但要理解西方现代的身体宪法,还要理解西方古典的灵魂宪法。Western classical soul constitution refers to community life style, which focuses on human soul. Its goal is the cultivation of civic virtue, and the realization of the goal depends on education. Modern western body constitution refers to the fundamental law in establishing a country, which focu-ses on human body. Its goal is to protect the rights of citizens, and to realize the goal depends on the legislative technology and institutional design. The shift of western constitutional concepts from ancient times to modern times has two main implications for China: First, "human" is the key to un-derstanding the western constitutional concept;Second,we should understand not only modern western body constitution, but also western classical soul constitution.
