农产品全球贸易治理宪政的国际法路径设计

摘　　要：农业生产的弱质性和粮食安全的战略性使得国际农产品贸易充斥着保护主义因素。经济全球化背景下的农产品贸易自由化实际上加剧了贸易扭曲和不公平。具体形态表现为与农产品有关的多边贸易关系的不公平、国际贸易规则的不公平、相关主体的不公平和国际贸易行为的不公平。因此,农产品公平贸易须置于由宪政的国际法所推动的全球贸易治理体系之中予以推进。最根本的是要实现程序公平和实质公平之统合。程序公平的实现须完成治理体系的正当性论证。而实质公平则有赖于构建多元主体民主参与和公民本位的贸易民主化治理机制,强化国际法与国内法在宪政的国际法框架中的联动,以及充分发挥世界贸易组织争议解决机制对农产品贸易规则的司法造法功能。The weak quality of agricultural production and strategic feature of food security fill interna-tional trade of agricultural products with protectionism. In fact,free trade of agricultural products in the context of economic globalization aggravates the unfairness and distortion of trade. The current legal sys-tem of trade in agricultural products can be concluded in four aspects： （1） The multilateral trade relations of agricultural products are not fair; （2） The international trade rules are not fair; （3） The related partici-pants of international trade of agricultural products are not fair; （4） The international trade behaviors of agricultural products are not fair. Therefore, the fair trade of agricultural products should be assessed un-der the global trade governance framework advanced by international law of constitutionalism. The combi-nation of the procedural aspect of fairness and the substantive aspect of fairness is the most fundamental means. The realization of the procedural aspect of fairness needs to complete argumentation of the legiti-macy of governance system. The realization of the substantive aspect of fairness relies on constructing trade democratic governance mechanism of democratic participation and citizen-orientation, strengthening the combination of the domestic law and international law under the framework of international law of con-stitutionalism, and giving full play to the judicial law-making function through the WTO dispute settle-ment mechanism.
