被告人品格证据在中国适用的理据分析

摘　　要：品格证据是以英美法系为首的国外证据制度中的特色,却并非其独有,中国古代亦有相关品格证据的体现。虽然目前我国诉讼法中还没有对品格证据进行认定,但在司法实践中却有相关品格证据的体现。建构我国的被告人品格证据制度,应当认真审视英美法中对品格证据的可采性、警惕性以及当事人作用的发挥,以及我国古代仁者之刑、尽情察狱的主张。在司法实践中,对未成年嫌疑人的社会调查制度以及彰显社会情理的个案都对我国被告人品格证据制度的构建与适用予以肯定。构建符合中国特色的品格证据制度,在我国证据制度的改革发展史上有重要意义。Character evidence is a characteristic of foreign evidence systems,particularly the British and American systems,however,there were also signs of using character evidence in ancient China. Although it is not yet officially recognized in China's procedural law,it does exist in juridical practice. Establishment of the character evidence system needs to review British and American laws and take into consideration the acceptability of the evidence,vigilance,litigant's role,as well as ancient China's ideas of benevolent punishment and responsible jail investigation. In practice,the social investigation system for juvenile suspects and individual cases that highlight social reasoning also have favorably confirmed the establishment and application of the character evidence system. The establishment of this system with Chinese characteristics has important historical significance in the evidence system's reform and development.
