摘 要:随着我国加入WTO以及签署日益增多的有关劳务贸易国际条约,国际劳务派遣所涉及的法律关系及法律主体权利保护成为国际法主要关注对象。而相较于国内劳务派遣而言,国际劳务派遣具有的国际性特征使得各国及地区对国际劳务派遣各方权利义务、法律关系、劳务派遣合同性质以及法律适用等方面规定大相径庭,国际劳务派遣的法律适用难以抉择使得国际劳务派遣员工的权利难以得到救济。为解决这些问题,需从现存国际劳务派遣问题出发,结合国外诸多国家立法实践,寻求冲突解决方式,以完善我国立法,实现利益与公平的平衡。With China's accession to the WTO and the signing of an increasing number of international treaties on trade in labor services, the legal relationship and the protection of the legal fights of international labor dispatch become the main concern of international law. Compared with the domestic labor dispatch, the international character of the international labor dispatch has made the countries and regions of the internation- al labor dispatching parties to the rights and obligations, legal relations, the nature of labor contracts and the application of law and other aspects of very different. The difficulty in international labor dispatch to choose the application of law makes the right of employees difficult to get relief. In order to solve these problems, it is necessary to solve the existing problems of international labor dispatch and combine with the legislation practice of many foreign countries in order to perfect our legislation seek resolution of conflict, improve our legislation and achieve the balance of interests and equity.
