澳门民事保全程序之研究

摘　　要：澳门特区法律具有典型民法法系特征。保全程序作为澳门民事诉讼程序的组成部分,除了具有一般民事保全程序普遍存在临时性、紧急性、附随性特点外,还具有法典化、针对性强、公平保护当事人权益、功能强大等独特性。当然澳门民事保全程序也有缺陷,如在保全程序分类、实质要件、上诉和赔偿责任等方面存在着不足,这是需要改进与完善之处。The Macao SAR law has the typical peculiarity of civil law legal system, As an important part of the Macao civil procedure, the preservation procedure has three features including temporality, emergency and subjection, as well as other characteristics like codification, directionality, fair protection and powerful functionality. However, it also has its weaknesses, which are mainly focused on the classification, the substantial elements, appeal procedure and liability of compensation, etc. By comparing with the civil preservation procedure in other legal areas, the author gives some suggestions in the aim of improving the preservation procedure.
