摘  要:我国农民住房财产权抵押具有特定内涵,完善农民住房财产权抵押贷款是解决"三农"问题的关键。现行农民住房财产权抵押制度存在严重法律缺陷,农民住房财产权抵押市场不健全、风险缓释机制不完善导致农民住房财产权抵押贷款在实施中面临困境。完善途径在于重构农民住房财产权抵押规则,通过健全抵押登记制度、价格评估体系和交易市场来完善抵押市场,通过构建多元担保机制、创建政府风险基金、完善社会保障体系来完善风险缓释机制。The mortgage of property rights of farmer housing in China has its specific connotation. The perfection of mortgage loan of property right of farmer housing is the key element to solve the issues of agriculture,farmers and rural areas. Because of the serious legal defects of the current system of mortgage of property rights of farmer housing as well as the imperfection of the market of mortgage of property right of farmer housing and risk mitigation mechanism,the mortgage loan of property rights of farmerhousing has faced difficulties during the process of implementing. The way to perfect the system of mortgage of property rights of farmer housing is as follows: reconstituting the rule of mortgage of property rights of farmer housing;perfecting the market of mortgage of property rights of farmer housing by improving system of mortgage registration,price evaluation system and trading market; perfecting the risk mitigation mechanism by establishing multiple guarantee mechanism,creating government risk funds and perfecting of social security system.
