摘　　要：警察刑事自由裁量权的行使是个敏感又绕不过去的问题。本文从实然性角度出发,认为警察享有刑事自由裁量权,并论证了其存在的正当性和必然性,提出警察刑事自由裁量权的范围包括事实认定和法律适用两个方面,据此对警察刑事自由裁量权的规制提出了一些建议。The police exercising the criminal discretionary power is a sensitive problem which is hard to turn a blind eye. Form the point view of reality, the article points out that the police should enjoy the crim- inal discretionary power, demonstrates its existence legitimacy and inevitability, and puts forward two as- pects of police criminal discretion, including factual and legal application. At the end, it makes some sug- gestions on the regulation of criminal discretion.
