摘　　要：澳门特区文化遗产保护法的颁行,确立了文化遗产权的法律概念,将公开咨询确定为强制性法律程序,制度变迁之下将文化遗产作为经济策略对待。在法律的实施过程中,存在多头管理效率不高;文化遗产的保护与开发关系有待进一步明晰等问题。提出建构文化遗产保护法律部门;出台实施细则和健全澳门文化遗产的公众监督的参与机制等制度完善的建议。The cultural heritage protection law in Macao Special Administrative Region has three features. Firstly, it establishes the legal concept of cultural heritage rights. Secondly, it recognizes the public consultation as a compul- sory legal process. Lastly, in the sense of institutional changes, the cultural heritage protection has been regarded as an economic strategy. In the process of implementing the law, there are many problems such as the low efficien- cy of multi head management, the need to clarify the relationship between the protection and development of the cul- tural heritage. It puts forward some suggestions on the establishment of the legal department for the protection of cultural heritage, the introduction of detailed rules for implementation, and the participation mechanism for the public supervision of the cultural heritage of Macao.
