摘　　要：高校自治是其实现人才培养、科学研究、学术传承等功能的内在要求,也是民主和法治的体现。高校自治在我国有明确的法律依据,国家机构和公民都应当尊重这项制度。高校的自治也应有其范围和界限,若得不到有效的监督,可能出现权力滥用的现象,以致侵害到师生的合法权益。适当的引入司法审查制度来监督高校的行为,不仅有利于高校自治的健康运行,也有利于保障自治目的实现。University autonomy is a requirement for national higher education, science research and academic development, it is also the continuation of democracy and legality. Government sectors and civics ought to respect university autonomy because it has exact legal basis. Nevertheless, boundaries should be set for university autonomy since it may cause power abuse or damage of the interests of faculty and students if it has no restricts and supervision. The introduction of judicial review to supervise the university behavior is good not only for its administration, but also the goal of autonomy.
