摘  要:劳动合同冲突法规则之所以需要在一般合同冲突法规则以外"另立门户",主要是因为劳动者在劳动合同关系中的相对弱势地位。因此,彰显弱者保护原则应为此类特别冲突法规则的特色。对意思自治原则的限制或排斥、采用最密切联系原则增加灵活性、区分个人劳动合同与集体劳动合同构成晚近国外此类先进立法的主要共性。我国现行立法在术语的明确性和弱者保护力度上尚有不足。最高人民法院在未来的司法解释中可从四方面对其予以补充和完善:明确劳动合同的内涵和外延,界定"工作地"的含义,明晰劳务派遣中的合同关系,释明劳动合同冲突法与"直接适用的法"制度之间的关系。The conflicts rule for employment contracts is made outside of the conflicts rule for general contracts, the reason for which mainly lies in the fact that employees are treated as the weaker party in an employment contract. Therefore the principle of the protection of the weaker party stands out as the prominent feature of such a conflicts rule. The common attributes of the recent legislations abroad in this area predominantly include the restriction or exclusion of party autonomy, the adoption of the principle of the closest connection to enhance flexibility of such a rule, the dichotomy between individual employments and collective em- ployment contracts. The defects of China' s legislation are obvious : the main terms are ambiguous and the weak party does not en- joy enough protection. It should be complemented and perfected from four aspects in the future judicial interpretation by the Su- preme People' s Court : explanation of the connotation and scope of employment contracts, definition of the place of work, identification of the contractual relationship in a labor dispatch, clarification of the relationship between the conflicts rule for employment contracts and the doctrine of "rules of immediate application".
