摘 要:证人出庭制度的完善是全面推进依法治国的重要内容。通过试点和调研发现,我国的证人出庭制度尚有证人出庭率低等问题,导致影响实体错误和程序不公之风险。但通过试点也发现,这些问题可以通过改革加以解决。根据试点和调研的经验,为改变当前证人出庭制度的困境,应通过重新确定必须出庭证人的范围、明确证人无需出庭的案件类型、加强强制证人出庭制度实施、规定完整的亲属免证特权并允许其自愿作证、完善证人保护和经济补偿等证人出庭保障机制、将伪证罪的适用限于针对故意作出的庭上伪证等六方面改革措施对该制度加以完善,从而符合庭审实质化的要求。Improving the witness-in-court system is an important component in advancing law-based governance in an all-round way. As the pilot program and surveys show,the witness-in-court system still has deficiencies such as low show-up rate,which results in risks of affecting substantive mistakes and injustice procedures. However,the pilot program also found that reform could be solutions to these issues. Based on the experience,six ways are required to change the current difficult situation and improve the system,including re-determining the scope of witnesses in court,clarifying types of cases where witnesses do not need to testify before court,enforcing the witness-in-court system,specifying complete spousal privilege and allowing voluntary testimony,improving the security mechanism including witness protection and economic compensation,confining the scope of perjury within deliberate perjury before court,so as to follow the requirement of making court trials substantive.
