贪污犯罪视阈下死缓制度的困境与出路

摘　　要：死缓制度作为我国刑法特有的宽容政策,在教育改造罪犯方面发挥了积极的作用,具体到惩治贪污犯罪方面,犯罪分子在死缓制度的教育感召下,绝大多数能够认真悔过,改过自新。但死缓制度在实践中也陷入了诸多困境,主要表现为死缓制度成为贪污犯罪分子规避刑罚的工具以及死缓制度异化为无期徒刑等。为增强死缓制度在惩治贪污犯罪行为方面的作用,应该明确死缓制度的适用标准、细化死缓与无期徒刑的分档区分、灵活确定死缓的考验期等。The system of death sentenee with reprieve, a generous and forgiving policy unique in China＇ s criminal law, has facilitated the rehabilitation of criminals. When it comes to the crime of con＇uption, most of the criminals moved by this unique system would repent and get rehabilitated. However, this system has in practice been confronted with many predicaments, one of which is the intention of criminals committing corruption to use this system to evade punishment and the reduction of this system to life imprisonment. In order to ensure the intended effect of the system of death sentence with reprieve, the scope or standard of application should be made clear, the categories of death sentence with reprieve and life imprisonment specified, and the probation period made flexible.
