对死刑缓期执行期间故意犯罪结局的解读

摘　　要：死缓变更执行死刑的条件是"故意犯罪,情节恶劣",此处的"情节恶劣"是指故意犯罪本身犯罪情节恶劣,以及抗拒改造情节恶劣,二者缺一不可;死缓考验期间故意犯罪未执行死刑的条件为"故意犯罪,情节不恶劣的";告诉才处理的犯罪应属于死缓考验期间未执行死刑的"故意犯罪"之列;死缓考验期间的故意犯罪需查证属实;死缓犯在考验期内既有故意犯罪又有重大立功表现的,除应判处死刑立即执行的以外,不分先后,故意犯罪情节恶劣的应在2年考验期满后减为无期徒刑,故意犯罪尚不属于情节恶劣的宜在2年考验期满后减为25年有期徒刑;故意犯罪必须发生在死刑缓期执行期间,除死缓犯在考验期内实施了应当判处死刑立即执行的犯罪外,其他情形均应待2年的考验期期满后再决定死缓犯的结局。The conditions of death penalty with probation changing into death penalty are‘intentional crimes＇ and ‘flagrant circumstances＇,‘flagrant circumstances＇ refer to serious plots existing in intentional crimes and labor reform resisting,both of which are indispensable.Where a criminal sentenced to death penalty with probation commits an intentional crime with no flagrant circumstances＇ within the period of probation,his sentence shall be commuted to life imprisonment. Where the crime is committed intentionally but the death penalty is not executed,the scope of ‘intentional crimes＇ mentioned above is limited to the crimes of ‘to be handled only upon complaint＇. The intentional crimes during the suspended execution of death penalty must be verified. Any criminal who is sentenced to death penalty with probation commits an intentional crime as well as renders major meritorious services,regardless of the order,in addition to executive death penalty immediately,if the circumstances are flagrant,his sentence shall be commuted to life imprisonment upon the expiration of the two-year probation,otherwise,his punishment shall be commuted to fixed-term imprisonment of 25 years. The situation of intentional crimes must occur during the condition of death penalty with probation,meanwhile,in addition to reaching the degree of executing death sentence immediately,the decision of the sentence should be reached after the expiration of two years.
