摘 要:韩国的劳动时间一直位居经合组织(OECD)成员国前列,受长时间劳动的影响,韩国的过度劳动也显得较为典型。尤其近年来,韩国过劳灾害呈逐渐增加之势,这对整个韩国社会经济的发展带来了严重影响,已经引起韩国政府的高度重视,从立法等层面相继采取了一系列措施对过劳灾害进行管理。本研究在韩国长时间劳动的背景下,对韩国过劳灾害认定基准的立法变迁、具体内容进行分析,并结合判例,对韩国过劳灾害的认定基准进行初步探讨。South Korea's labor time has been among the forefront of 0ECD member states, due to the lungtime labor, the excessive labor is also more typical in South Korea. Especially in recent years, the overwork disasters in South Korea shows a gradually increase tend, which brings a serious bad impact on the development of the South Korea' s social and economic development. It also has attracted the South Korean government' s attention, the govermnent had token a series of measures from the legislative level to deal with the overwork disaster. Under the background of long labor in Korea, this study analyzes the legislative changes and specific contents of the benchmarks of the South Korea's overwork disaster, combined with the precedent, to conduct a preliminary discussion of the benchmarks of the South Korea's overwork disaster.
