摘　　要：目前银行卡市场成长迅速,一方面民众享受着银行卡所带来的方便性,另一方面银行卡盗刷案件等一连串矛盾不断滋长。对于银行卡盗刷案件频发,究其原因,为银行卡相关法律体系发展落后、政府监管部门与司法执法机关打击力度不强、商业银行怠于行使其社会责任,持卡人防范意识薄弱等多方面的原因。以此视角,国家要完善立法工作,努力构建层次化的银行卡安全保障体系,尽快出台相关司法解释,让同案得到同判。加大政府监管部门与司法执法机关打击力度,建立多方信息共享机制,推行举证责任倒置原则,并结合推定规则和"合理分配"原则灵活运用。银行应积极履行社会责任,强化银行卡技术防备能力建设,提高金融IC卡换卡速率,打造安稳的用卡环境,增强内控机制,并积极扩展"银行卡盗刷险"业务。Bank card market is growing rapidly, people enjoy the convenience brought by the bank card at the same time, but also to stimulate the bank card stolen brush case, such as a series of contradictory growth. For frequent fraudulent bank card case, the reason is the development of the legal system bank card leave behind, government regulators and judicial authorities have not done enough to combat, the commercial banks lazy to exercise their social responsibility, the cardholder awareness weak and so on. In this perspective, the country can improve legislation and build a level of bank card security system. Introducing relevant judicial interpretations, so that similar cases to see to get the same sentence. We should strengthen the government supervision departments and judicial authorities to combat efforts, the establishment of multi information sharing mechanism, the implementation of the principle of inversion of the burden of proof, and the presumption of rules and the ＂rational distri- bution＂principle flexible use. Banks should actively fulfill their social responsibilities, strengthen the bank card technology against ability construction, improve the exchange rate card financial IC card, to create a safe environment with a card, strengthen internal control mechanism, and actively expand the bank card fraudulent insurance business.
