摘 要:《劳动合同法》制定实施已过8年。此间,该法所引发的争议在社会上就没有中断过。对一部实施中的法律进行评价的着眼点应当是起草时的理由和实施后的效果。《劳动合同法》从制定到实施,我国实现了劳动合同签订率从低下到高企,短期劳动合同从盛行到消失,劳动者违约金从常见到少见的立法目的,也同时遭遇了劳动派遣从限制到泛滥的相反效果。总体来看,《劳动合同法》已经解决了当时要解决的主要问题,劳动派遣仍然是《劳动合同法》面临的主要挑战。The Labor Contract Law has been in effect for eight years, during which time controversies caused by the law never ended. The evaluation of a law in effect focuses on the cause of the legislation and its effect. From its enactment to its implementation, the Labor Contract Law has achieved its purposes of increasing labor contract signing rate,eliminating short-term labor contracts,and reducing cases of penalty for breach of contact. However,there also exists the negative effect of the unchecked spread of labor dispatch. On the whole,the Labor Contract Law has solved the major problems at the time,while labor dispatch remains the main challenge faced by it.
