摘  要:新《行政诉讼法》第五十三条首次以立法形式确立了具有中国特色的附带性司法审查模式,并将审查范围限定为"国务院部门和地方人民政府及其部门"制定的规范性文件,且不包含规章。我国目前法律、行政法规对"国务院部门及地方人民政府部门"缺乏明确的界定,地方性法规、规章的规定又存在差异性,缺乏统一的标准。为化解该困境,推动新法有效实施,可以制定新的行政法规来确定统一的制定主体标准,并通过新的司法解释对"国务院部门及地方人民政府部门"作出合法的扩大性解释,从而使审查范围"在可控的范围内稳步推进"。Article 53 of the new Administrative Procedure Law for the first time in the form of legislation established the Chinese characteristics of the incidental judicial review model, and the scope of the examination was limited to "the State Council and the local people's government and its departments",without containing the regulations. There is no clear definition of local laws and regulations in China's current laws and administrative regulations on the "State Council departments and local people's government departments". Meanwhile, there are differences in rules and regulations and no specific standards at all. In order to resolve the dilemma and promote the effective implementation of the new law, new administrative regulations can be formulated to determine the formulating subjects and the standard as well, and to make a legally extended interpretation through the new judicial interpretation of the "State Council departments and local people's government departments", so that the review can steadily advance within a controlled scope.
