摘　　要：本文在实证捋析140份生产、销售假药罪判决书及其所揭示的有关问题基础上,对比分析了药品监管法律制度,进而提出健全药品基层监督执法机制、加强药品普法宣传、规范药品流通以及完善《药品管理法》配套法律法规等建议。Based on an empirical analysis of 140 production and sales counterfeit drug offences in Sichuan province and the problems, this paper analyzes the legal system of drug supervision, and puts forward the follow- ing suggestions： improving the basic law enforcement mechanism of drugs, strengthening drug publicity, regulating drug circulation, and perfecting the supporting laws and regulations of Pharmaceutical Administration Law, etc..
