摘 要:党的十八届四中全会提出了以审判为中心的诉讼制度改革新目标。实施以审判为中心的刑事程序改革需要全面把握以审判为中心的诉讼制度改革目标提出的时空维度,准确理解以审判为中心的诉讼制度改革的含义和内容,深入分析以审判为中心的刑事程序改革所面临的机制困境及体制难题。刑事司法职权配置优化应当成为我国当前刑事司法体制改革的重中之重。在调整侦查权、检察权、审判权职权配置的同时,理顺三者之间的关系已经成为建立以审判为中心的刑事司法体制及司法权运行机制的前提条件及制度基础。The 4th Plenary Session of the 18th CPC Central Committee proposed for trial-centered litigation system reform as a new goal. The implementation of trial-centered criminal procedure reform requires compre- hensively grasping the time-space dimension of the proposed trial-centered goal, accurately understanding the meaning and content of the trail-centered litigation system reform, and deeply analyzing the institutional,dilemma and systematical difficulties the trial-centered criminal procedure reform faces. This paper tries to point out that optimizing the allocation of criminal judicial power should be most important in the current criminal judicial system reform in China. While adjusting the distribution of the right of investigation, prosecution and judicial power, the relationship among the three parties has become a prerequisite and an important foundation for the establishment of the criminal justice system and operation mechanism.
