延续法统:村规民约对固有习惯法的传承——以贵州省锦屏县平秋镇魁胆村为考察对象

摘　　要：贵州省黔东南苗族侗族自治州锦屏县平秋镇魁胆村的实践表明,村规民约成为传承固有习惯法的主要方式,侗族固有习惯法主要通过村规民约得以传承和弘扬。魁胆村在议定、修改村规民约时,从尊重、选择的原则出发传承良善固有习惯法,延续法统。魁胆村村规民约广泛传承了固有习惯法的观念和规范,具体包括民主机制、族长地位、敬老爱幼、保护妇女、团结互助、热心公益、爱护公物、诚实守信、严禁造谣惑众、禁止内勾外引、吃款处理、喊寨处罚、调解收费等。由于形成了遵守习惯法的传统,村规民约又传承了固有的法统,魁胆村民普遍具有守法遵规意识,严格依约办事,自觉按规行为,魁胆村形成了遵纪守法、遵规守约的良好社会环境。我们应当重视村规民约在传承和弘扬良善习惯法、延续固有法统方面的积极作用,推进全面依法治国的进程。The practice of the Kuidanvillage, Pingqiu town, Jinping County, Qiandongnan Miao and Dong Autonomous Prefecture, Guizhou Province, China shows that the village regula- tions are the main ways of inheriting the inherent customary law. The inherent customary law of the Dong nationality is inherited and developed through the village regulations. In the process of negotiating and amending the village regulations, the Kuidan Village inherits the good inherent customary law and continues the ＂legally constituted authority＂, from the principle of respect and choosing. The village regulations of Kuidan Village widely inherit the concepts and norms of the inherent customary law, including the democratic mechanism, patriarchal ~tatus, respect for the old and caring for young people, protecting women, solidarity and mutual assistance, being en- thusiastic about public service, taking care of public property, honesty and trustworthiness, strictly shunting down rumors of confusing the public, prohibiting inside and outside collusion, punishing public funds to eat and drink, punishment of calling along the village, mediation fees and so on. As a result of the tradition of observing customary law and the inheritance of the inher- ent laws and norms in village regulations, the villagers generally have a common sense of compliance with the laws, follow strictly the rules, and behave consciously under the guidance of regulations. As a consequence, the Kuidan Village has established a good social environment of compliance with the laws and following the regulations. We should pay attention to the positive role of the village regulations in inheriting and developing good customary law and continuing of the inherent ＂ legally constituted authority＂, which contributes to promoting comprehensively the process of rule of law.
