摘　　要：刑事诉讼文化的当代变迁与刑事诉讼的制度变革相伴共生、交互影响,深刻反映并体现了现代化与市场经济发展进程中当代中国的社会变迁。在与当代中国政治、经济和司法实践相互适应、有效互动的过程中,刑事诉讼话语体系实现了以阶级为核心到以人权为核心的转变,价值观念、思维方式、社会心理也发生了相应的转变。刑事诉讼文化的未来发展不仅是对不得强迫自证其罪等普遍适用的刑事诉讼观念的进一步认同,还需要对实质正义理念等传统诉讼文化中合理因素进行继受和对刑事和解等当下司法实践经验进行总结与提升,追求中国特色的刑事诉讼话语体系,实现刑事诉讼文化的转型创新。The contemporary changes of criminal procedural culture coexist and interact with the re-form of criminal procedure system, and profoundly reflect and embody the social changes of China in the process of modernization and the development of market economy. In the course of adapting and interacting with the political, economic and judicial practice of contemporary China, the discourse system of criminal proceedings has realized the transition from taking class as the core to taking human rights as the core, val-ues ,ways of thinking and social psychology have also undergone corresponding changes. The future devel-opment of the criminal litigation culture is not only the further recognition of the universal concept of crimi-nal procedure such as not compel self - incrimination, but also needs the conclusion and promotion of the current judicial practice of the traditional judicial culture, such as the essence of justice and the rational factors, together with the criminal reconciliation. Last but not the least, the development is to pursue the criminal procedural discourse system with Chinese characteristics, and realize the transformation and innova-tion of the criminal procedural culture.
