摘 要:专利强制许可制度是防止专利权滥用的重要手段。我国虽已经建立了专利强制许可制度,但目前尚未实施。面对越来越严峻的公共卫生形势,在大规模传染病(例如禽流感、SARS)爆发等紧急情况下,如何利用现有的强制许可制度,解决药品可及性问题,有其探讨的必要。本文通过分析我国强制许可法规的发展过程,从现有的制度设计出发,通过简化流程、放宽限制等方式,减少制度本身对于药品专利强制许可的制肘,并借鉴他国经验,来完善我国的药品专利强制许可制度。Patent compulsory license system is an important means to prevent the abuse of patent rights. Although patent compulsory license system has been established in China, it has not been implemented yet. Faced with more and more serious public health situation, it is very necessary to discuss how to use the existing compulsory license system to solve the drug access problem in the case of large infectious disease(such as bird flu, SARS) and other emergency situations broke out. This article analyzes the development of compulsory license law in our country, starting from the existing system, by simplifying the process and liberalizing the restriction in order to reduce the system itself restriction for the drug patent compulsory license. And draw lessons from other countries' successful experiences to improve the drug patent compulsory license in China.
