摘 要:行政权限争议问题已成为国家治理体系和治理能力现代化推进的阻碍。经由诉讼机制不能解决行政权限争议问题:从实定法视角论,经由诉讼机制解决行政权限争议既缺乏明确的法律依据,又无可资操作的针对性程序;从产生的原因分析,行政权限争议并不具备诉讼解决的基础条件;从裁判主体方面考量,我国法院当下还不具备对行政权限争议问题施以司法裁判的资格,我国法官目前也没有对行政行为进行合法性审查的足够能力。行政权限争议问题的解决须仰仗立法,由国家权力机关作为解纷主体。Administrative dispute has become the national governance system and the modernization of govern- ance to promote obstacles. From the perspective of practical law, the administrative litigation mechanism to resolve administrative disputes is still lack of clear legal basis, there is no operational procedures for the operation. On the basis of the qualification and ability of the subject of the referee, at present, the courts of our country do not have the qualification of judicial adjudication in the case of administrative dispute, and the administrative trial judge has no a- bility to carry out judicial review on the legitimacy of administrative action. In our country, the power of administra- tive power dispute should avoid relying on legislation, its rational solution depends on the state power organs.
