“裁执一体化”财产保全的逻辑与改革

摘　　要：财产保全"裁执一体化"程序操作模式的直接目的是有效查控财产保全对象。"裁执一体化"模式更加侧重于审理财产保全案件有无执行到位的可能性,财产保全立案、审判、执行程序的结构也因此更为密切和集中。"裁执一体化"模式虽然能够较好地契合既有的制度条件,也能够对个案处理表现出一定的调适性,但所形成的财产保全制度"低水平"均衡运行状态仍然必须打破。技术革新与司法体制改革形成了打破"低水平"均衡状态、改革"裁执一体化"模式的外部条件。通过合理界定法院内设机构的职能和人员的权责分工,拓展财产信息查明途径以及充实财产保全案件审理的正当性基础,可以促进财产保全制度司法实践向规范目的回归。The operation mode of integration of judging and enforcing in freezing order case is aimed at controlling the freezed property. The structure and function of docket, judgment and enforcement in freezing order case become more closed and concentrated, because of the object of the operation mode. The operation mode of integration of judging and enforcing is not only good for application of the institution, but also suitable for dealing with individual cases, however, the low-equilibrium of freezing order has to be reformed. The innovation of technology and reform of judicial system have offered the opportunity to change the mode and equilibrium. We can achieve the reform of freezing order by identifying the function of institution, balancing the power and duty, finding new ways to identify information of property and providing much justification of judgment.
