公立高校开除学籍处分的司法救济微探

摘　　要：公立高校的管理必须践行全面依法治国的基本精神,对其开除学籍处分进行救济必须符合全面依法治国的基本要求。公立高校的开除学籍处分具有惩戒性和法定性两大特征。这一处分类型的设置具有正当性和可诉性,对其进行司法救济应选择行政诉讼的相关规定和程序,遵循合法性审查为主兼顾合理性审查的原则,从长远角度看,还应设置行政复议前置程序。同时,法院在审理过程中对所涉校规校纪的审查要遵循间接审查的原则。The management of public colleges and universities must carry out the basic spirit of the comprehensive framework for promoting the rule of law. Judicial relief to the punishment of expulsion from school must conform to the basic requirement of the comprehensive framework for promoting the rule of law. At public colleges and universities, the punishment of expulsion from school is featured by strong punitivity and statutory application. As the setting of this type of punishment is valid and actionable, the judicial relief to it should choose relevant provisions and procedures of administrative proceedings as well as the principle of focusing on legality review, supplemented by reasonable review. In the long term, it should also set the administrative reconsideration procedure. Besides that, the court＇s review of school rules involved must follow the indirect review principle during the process of trial.
