美国法学院法律职业化教学模式对我国的启示

摘　　要：美国法学院以培养律师为目标,在课程设计和教学内容上都充分体现了法律实践性强的特点。美国律师协会法学教育和律师准入委员会制订的合格法学院的准入标准,是各大法学院制订教学目标和计划的主要依据。合格法学院的准入标准对法律实践课程的学分、实践形式、实践过程提出了明确而具体的要求。本文以笔者访问的埃默里大学法学院的Doing Deal系列课程为例,展现美国法学院职业化教学的具体模式,以此提炼出值得我国法学教育借鉴的经验。law schools in the United States aim to train lawyers, fully reflecting the characteristics of law practice in the curriculum design and teaching content. The access standards for law schools, established by the law society and the admission committee of lawyers, are the main basis for the development of teaching objectives and plans. The admission standards of a qualified law school put forward specific and concrete requirements for the credit, practice form and practice process of the legal practice course. Taking the Doing Deal series of courses in the law school of Emory University as an example, this article shows the specific mode of professional teaching in the American law school, and extracts the experience which is worth borrowing for our country＇s legal education.
