论中国警察法律体系中的“紧急情况”

摘　　要：警察执勤执法面临各种紧急情况。考察警察法中的"紧急情况"条款,刑事诉讼法律规范中的规定具体明确,而《治安管理处罚法》未有相关条款,《人民警察法》及道路交通安全法律规范中的规定则较为原则和笼统。需要立法机关通过立法解释,行政机关以行政解释或制定部门以规章的形式明确"紧急情况"的种类和具体情形,以便有效指导警务实践。The police＇s law enforcement is confronted with various emergencies. The clauses for ＂emergencies＂ in the police law and the provisions in criminal procedure law are explicit and specific. However, ＂Public Order Management and Punishment Law＂ lacks of relavant clauses. The stipulations in ＂People＇s Police Law＂ and ＂Road Traffic Safety Law＂ are relatively general. The legislatures are expected to make legislative interpretation, and the administrative organizations are expected to make administrative interpretations or establish department regulations to clarify the category of ＂ emergencies＂ and specific situations so as to effectively instruct the policing practice.
