行政机关“滥用职权”的检察监督

摘  要:检察机关对行政机关的检察监督分为"直接监督模式"和"间接监督模式",当前监察委体制改革保留了检察机关的间接监督职权。在间接监督模式中,《行政诉讼法》上"滥用职权"的主要情形是目的不恰当、考虑不该考虑的因素、自由裁量的不当拘束、不以主观过错为构成要件。行政法中"不法"和"违法"有不同的构成要件,而《行政诉讼法》中的行政机关"滥用职权"属于"违法",只需行政行为客观上表现为违法,不需要以主观过错为构成要件。Prosecutorial organizations' prosecutorial supervision of administrative organizations falls into direct supervision mode and indirect supervision mode. The indirect supervision mode is preserved in prosecutorial system reform. In indirect supervision mode, power abusing is mainly manifested as improper objective, consideration of the factors that shouldn't be taken into account, inappoapriate restrict of discretion, and non-subjective faults-based constitutive requirements. There are different constitutive requirements between illegitimacy and law violation. In light of Administrative Procedure Law, power abusing on the part of administrative organizations is designated as law violation, which calls for objective administration manifestation as law violation instead of subjective faults-based constitutive requirements.
