摘 要:结合《中华人民共和国物权法》及其司法解释的相关内容,分析司法实践中,浮动抵押常见问题多发的原因、纠纷的种类及现状等,提出进一步完善有关法律操作层面的建议和对策:将浮动抵押的主体仅设定为公司类企业,主体范围中删除个体工商户和农户;以企业的全部资产作为浮动抵押的客体;对于抵押效力消失问题,建议当事人在抵押合同中增加约定限制性条款,适当地限制债务人对押品的自由处分行为等。Based on the law of the People's Republic of China Property Law and its judicial interpretation of the related content. Focusing on the judicial practice,this thesis studies the causes of the common problems,types and status quo of disputes in floating mortgage,etc.,and further puts forward suggestions and countermeasures to improve the relevant legal practice. The body of the floating mortgage is only set up into the category of companies and the main area removes individual businesses and farmers. It is recommended that all assets of the enterprise be the object of floating mortgage. For the problem of the loss of mortgage effectiveness,it is recommended that the parties increase the stipulation restriction clause in the mortgage contract,and appropriately restrict the free disposal of the mortgagee and so on.
