摘 要:设区的市立法权限是设区的市立法权的核心,但新《立法法》对此规定得不明确,导致设区的市立法权限存在一些不足:一是设区的市立法权限存在一些模糊之处;二是设区的市与省、自治区在立法重叠领域权限划分不清;三是设区的市与原较大的市立法权限存在不衔接之处。因此,我们必须要对设区的市立法权限予以完善,包括通过科学列举来厘清设区的市立法权限范围、明确设区的市与省、自治区在立法重叠领域的权限划分、实现设区的市立法权限与原较大的市立法权限的有效衔接等途径,以明确设区的市立法权限的范围,避免设区的市立法权的滥用。The limits of the legislative power are the core of legislation in cities with districts.However,the provision of this is not clear in the New Legislation Law,resulting in some shortcomings in the limits of the legislative power of cities with districts. First,there are some ambiguities in the legislative power limits between cities with district.Second,the legislative overlap areas are not clear among cities with districts,provinces and autonomous regions. Third,there are some places which are not connected well between cities with districts and the original larger cities in legislative power limits. Therefore,we must perfect the legislative power limits of cities with districts to clarify the scope,and to avoid the abuse,which including the following three means: Clarifying the scope of the limits of the legislative power of cities with districts through scientific enumeration; Clearing the limits of power division in legislative overlap areas among the cities with districts, provinces and the autonomous regions; Realizing the effective connection between cities with districts and original larger cities in the limits of the legislative power.
