关于纪检监察证据诉讼化的思考

摘　　要：在当前反腐败斗争日趋严峻的现状下,腐败案件多由纪委负责调查突破,而纪检监察机关将涉嫌犯罪的案件移送给司法机关的过程中,就涉及到纪检监察证据如何转化为刑事证据问题。当下纪检监察部门所移交证据的现实运行方式中实物证据以及言词证据转化过程中存在程序性问题,如目前纪检监察证据诉讼化在监督被动、程序规范、法律缺位方面所存在的弊端。纪检监察证据与刑事证据在内涵、属性、特征上既有区别又有联系,纪检监察证据向刑事证据转化共有必要性和可行性,要有效实现证据诉讼化,就必须构建统一协调机构、科学立法、提高办案人员素质。In the current situation of increasingly serious anti-corruption struggle,the Commission for Discipline Inspection are mostly responsible for the investigation of corruption cases,which involves how the case is transferred to the judiciary in the process.This paper analyzes the actual operation mode of the evidence transferred by the discipline inspection and supervision department,and deeply reviews the procedural problems in the process of physical evidence and the transformation of the words and evidence,and further points out that the current discipline inspection and supervision evidence litigation in the supervision of passive,procedural norms,absence of the existence of the drawbacks.And then through the analysis of the means to further analyze the discipline inspection and evidence and criminal evidence in the connotation,attributes,characteristics of the distinction and contact,the author analyzes the discipline inspection and supervision evidence to the necessity and feasibility of the transformation of criminal evidence,and how to effectively implement the evidence litigation put forward the construction of a unified coordinating body,scientific legislation,improve the quality of handling the case of specific recommendations.
