摘  要:我国农村宅基地制度存在许多缺陷,立法不完备,司法判决不统一。在农村普遍存在一户几处宅基地的情况,宅基地数量巨大,大量闲置,由于受现行法律制度的限制,宅基地不能自由转让继承担保抵押和投资入股,农村宅基地资源无法盘活,农村违法占地现象普遍,小产权房大量存在,解决好这些问题,国家应当尽快完善农村宅基地法律和政策,实现农村宅基地使用权依法流转。There are drawbacks in the rural homestead system in China with imperfect legislation and inconsistent judicial decision. One family generally has several homesteads and many homesteads leave unused.Limited by the present legal system, homesteads can not be free transferred, inherited, guaranteed, mortgaged and invested in capital. Thus the homestead resource can not be vitalized. There are many illegal land occupancies and limited property houses. To solve these problems, the state should perfect relevant laws and policies so as to facilitate the homestead transfer.
